Restriction of legal capacity is a last resort, whereby the court may decide to restrict certain legal acts of persons who are no longer able to make decisions on certain matters due to their serious health condition.
The court shall always take into account the extent and degree of incapacity to manage his or her own affairs. No one can be deprived of his or her legal capacity completely.
Even before the petition is filed, questions usually arise as to who, how and when will help the person to manage his or her property, to pay for his or her current needs, as well as to maintain the property and look after his or her shares in companies and cooperatives.
