JUDr. Martin Halada, LL.B., attorney at law, CBA No.: 19981, ID No.: 75417197, with registered office at Na Stezce 1328/7, 100 00 Prague 10 (hereinafter referred to as "Halada Legal" or "Administrator") is responsible for the processing of your personal data related to your visit to the website www.haladalegal.cz (hereinafter referred to as "Website").
This personal data processing policy (the "Policy") provides you with information about what categories of personal data we process about you, for what purposes and to what extent we process them, what entitles us to do so and for how long we are entitled to process them.
Your personal data may be processed by the Controller for the following purposes:
Personal data is processed by the Administrator both manually and automatically. Automated processing of personal data occurs mainly for the purposes of fulfilling the contractual relationship and offering services.
If you give Halada Legal your consent to the processing of your personal data for the purpose of sending you personalised marketing communications, either by email or by telephone contact, you acknowledge that the provision of this consent is voluntary and that you may withdraw your consent at any time in writing to Halada Legal or via the link provided in the email with the commercial communication. Consent is granted until revoked. Failure to provide consent shall not affect the performance of the contract.
Halada Legal only discloses your personal data to authorised persons, but only to the extent necessary for the fulfilment of the individual purposes of processing and on the basis of the corresponding legal title for the processing of personal data.
Personal data of third parties, which means personal data of employees and customers of the Controller's clients or suppliers and other natural persons involved in cooperation with the Controller, or other data received by the Controller from a client or supplier in connection with the conclusion or performance of a contract, will be processed in accordance w i t h applicable legal regulations in the area of personal data protection. This personal data will be used by the Controller for the purpose of fulfilling contracts with clients or suppliers. The Controller will process the personal data of third parties for the duration of the contractual relationship and for the period provided for by special legal regulations, if any. It will then be retained for a longer period if there is a justified need to retain the data in connection with a specific case.
As a data subject, you have rights in relation to the processing of personal data which arise from the law and which you can exercise at any time. These are the right (i) to access personal data, (ii) to have inaccurate personal data corrected and incomplete personal data completed, (iii) to have personal data erased if the personal data is no longer necessary for the purposes for which it was collected or otherwise processed or if it is found that it has been unlawfully processed, (iv) to restrict the processing of personal data, (v) the portability of the data, (vi) the right to object, after which the processing of the personal data will be terminated unless it is demonstrated that there are compelling legitimate grounds for the processing which override the interests or rights and freedoms of the data subject, in particular if the ground is the enforcement of legal claims, and (vii) the right to apply to the Data Protection Authority.
Right of access to personal data: If you want to know whether Halada Legal processes personal data, you have the right to obtain information about whether your personal data is being processed and, if so, you also have the right to access your personal data.
Right to rectification of inaccurate and completion of incomplete personal data: if you believe that Halada Legal processes inaccurate or incomplete personal data about you, you have the right to request its rectification and completion. Halada Legal will correct or complete the data without undue delay, but always taking into account technical possibilities.
Right to erasure: In the event that you request erasure, Halada Legal will erase your personal data if (i) it is no longer necessary for the purposes for which it was collected or otherwise processed, (ii) the processing is unlawful, (iii) you object to the processing and there are no overriding legitimate grounds for processing your personal data, or (iv) the legal obligation to process under European Union or national law has ceased.
Right to restriction of processing of personal data: in the event that you request restriction of processing, Halada Legal will make the personal data inaccessible, temporarily delete or store it or carry out other processing operations necessary for the proper exercise of the exercised right.
Right to data portability: if you want Halada Legal to transfer the personal data that it processes about you in electronic form on the basis of a contract or consent and that you have provided to them to a third party, you can exercise your right to data portability. If the exercise of this right would adversely affect the rights and freedoms of others, Halada Legal will not be able to comply with your request.
Right to object: The right to object to the processing of personal data that is processed for the performance of a task carried out in the public interest or in the exercise of official authority or for the protection of the legitimate interests of Halada Legal. If Halada Legal does not demonstrate that there is a compelling legitimate reason for the processing which overrides the interests or rights and freedoms of the customer, it will terminate the processing without undue delay on the basis of the objection.
In the event of repeated or manifestly unjustified requests for the exercise of the above rights, Halada Legal is entitled to charge a reasonable fee for the exercise of the right in question or to refuse to exercise it. You will be informed of such action.
PLEASE NOTE: Due to the specific nature of Halada Legal's activities (practice of law), the exercise of certain rights of data subjects may be significantly limited (in particular, for cases of processing of personal data relating to specific legal cases).
